FrogFen Terms and Conditions

1. Eligibility

You must be at least 13 years old to use FrogFen. If you are under the age of majority where you live, you may use FrogFen only with the involvement and permission of a parent or legal guardian.

FrogFen is not directed to children under 13.

2. App Store Distribution

FrogFen is distributed through Apple and may also be subject to Apple's terms, policies, and platform rules, including App Store and subscription terms that apply to your purchase or device.

These Terms apply between you and FrogFen. Apple is not responsible for FrogFen's content, support, maintenance, or claims relating to FrogFen except as required by applicable law or Apple's own terms.

3. License To Use FrogFen

Subject to these Terms, FrogFen grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, access, and use FrogFen for your own personal, non-commercial entertainment use.

This license does not transfer any ownership rights to you. FrogFen and its licensors retain all rights, title, and interest in and to FrogFen, including all software, gameplay systems, artwork, audio, branding, content, text, designs, and related intellectual property.

4. Subscriptions And Paid Access

Certain FrogFen features or game modes may require an active paid subscription.

For the current v1 launch model:

• FrogFen offers one monthly auto-renewable subscription through Apple;
• the subscription is intended to unlock Daily Challenge and Endless mode;
• eligible users may be offered a 2-week introductory free trial as presented by Apple; and
• subscription price, taxes, currency presentation, availability, and eligibility may vary by storefront or region and are controlled or displayed by Apple.

Auto-renewable subscriptions renew automatically unless canceled by the user. Payments are billed by Apple through your App Store account, not directly by FrogFen.

You are responsible for reviewing the subscription details presented in the app and by Apple at the time of purchase, including price, free-trial or introductory-offer eligibility, renewal timing, cancellation terms, and any taxes or local pricing differences.

You may manage or cancel your subscription through your Apple account subscription settings. If your subscription lapses, expires, is canceled, or cannot be renewed, access to subscription-gated features may be limited or removed.

5. Refunds

FrogFen does not directly process App Store subscription refunds.

Because purchases are billed and managed by Apple, refund requests, billing disputes, cancellations, and related subscription issues are generally handled by Apple under Apple's policies and processes.

6. Acceptable Use

You agree not to use FrogFen, or attempt to use FrogFen, in any way that is unlawful, abusive, disruptive, deceptive, or unauthorized.

Without limiting the foregoing, you may not:

• copy, reproduce, republish, sell, rent, lease, sublicense, distribute, or commercially exploit FrogFen except as expressly permitted by us;
• modify, adapt, translate, decompile, disassemble, reverse engineer, or attempt to derive source code, models, algorithms, files, or non-public functionality from FrogFen, except to the limited extent such restriction is prohibited by applicable law;
• alter, patch, tamper with, jailbreak around, inject into, instrument, intercept, emulate, spoof, or manipulate FrogFen or its runtime, local files, storage, requests, purchase flow, entitlement checks, or security features;
• bypass, defeat, interfere with, or attempt to bypass or defeat subscription restrictions, purchase validation, restore flows, access controls, or paywalls;
• use bots, scripts, macros, automation, scraping tools, replay tools, traffic generators, crawlers, packet interception tools, debuggers, memory editors, or similar methods to interact with FrogFen or related services in an unauthorized way;
• probe, scan, enumerate, attack, overload, scrape, crawl, benchmark, stress test, exploit, or attempt unauthorized access to FrogFen infrastructure or third-party infrastructure used by FrogFen, including any APIs, endpoints, Cloudflare-hosted services, Workers, storage buckets, caches, routing layers, CDNs, admin interfaces, logs, or non-public systems;
• interfere with or disrupt FrogFen's operations, servers, content delivery, backend services, or other users' access to FrogFen;
• submit malicious code, malware, denial-of-service traffic, or any harmful or destructive material;
• use FrogFen to infringe intellectual property, violate privacy rights, harass others, or violate applicable law;
• misrepresent your identity or affiliation, or attempt to impersonate FrogFen or another person or entity; or
• use FrogFen in any manner that could damage, disable, overburden, or impair FrogFen or its supporting services.

7. Enforcement And Suspension

FrogFen may investigate suspected misuse and may, with or without notice, suspend, restrict, terminate, or refuse access to FrogFen if we believe you have violated these Terms, interfered with FrogFen's operations, abused subscription features, or posed a risk to FrogFen, its users, or its infrastructure.

FrogFen may also preserve, review, and disclose relevant information where reasonably necessary to investigate abuse, protect rights or safety, enforce these Terms, or comply with law.

8. Gameplay, Availability, And Changes

FrogFen may change, add, remove, pause, or discontinue any feature, content, mode, functionality, backend service, or availability at any time, with or without notice.

We do not guarantee that FrogFen or any specific feature will always be available, uninterrupted, error-free, or compatible with every device, operating system version, region, or network condition.

FrogFen may release updates, patches, balance changes, content changes, and technical changes that affect gameplay, scoring, subscriptions, availability, or compatibility.

9. Intellectual Property

FrogFen and its associated content are protected by copyright, trademark, and other laws.

Except for limited rights expressly granted in these Terms, you receive no right or license to FrogFen's name, branding, logos, iconography, artwork, audio, text, or design; the app's code, data, files, backend systems, or infrastructure; or any content or materials made available through FrogFen.

Third-party names may appear in dictionary-recognized gameplay contexts. Their inclusion does not imply affiliation, sponsorship, or endorsement, and all trademarks remain the property of their respective owners.

10. Permitted Sharing

Subject to these Terms, FrogFen does not object to ordinary, non-commercial player sharing such as posting screenshots of gameplay, sharing scores or results, discussing the game online, and creating non-commercial commentary about FrogFen.

This does not give you the right to redistribute the app, extract files or data, copy assets, commercially exploit FrogFen content, or create derivative commercial products based on FrogFen materials.

11. Feedback

If you send FrogFen ideas, suggestions, bug reports, feature requests, or other feedback, you agree that FrogFen may use that feedback for any purpose without restriction, attribution, compensation, or obligation to you.

12. Privacy

Your use of FrogFen is also subject to the FrogFen Privacy Policy. Please review it carefully at /privacy/.

13. Third-Party Links And Services

FrogFen may link to or open third-party services, including Apple subscription management, the App Store, social media pages, or other websites. FrogFen is not responsible for third-party services, content, billing systems, policies, or practices.

Your use of third-party services is governed by those third parties' own terms and policies.

14. Disclaimers

FrogFen is provided "as is" and "as available" to the maximum extent permitted by law.

To the maximum extent permitted by law, FrogFen disclaims all warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, accuracy, availability, and that FrogFen will be uninterrupted, secure, or error-free.

Without limiting the foregoing, FrogFen does not guarantee that the app will always function without bugs or interruptions, that scores, saves, stats, badges, or other data will never be lost, that subscription access will never be interrupted due to Apple, network, or billing issues, that all content or features will always remain available, or that FrogFen will be free from attacks, failures, or third-party service disruptions.

15. Limitation Of Liability

To the maximum extent permitted by law, FrogFen and its affiliates, licensors, contractors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, savings, or use, arising out of or related to FrogFen or these Terms, even if advised of the possibility of such damages.

To the maximum extent permitted by law, FrogFen's total liability for all claims arising out of or relating to FrogFen or these Terms will not exceed the greater of the amount you paid to FrogFen for FrogFen in the 12 months before the event giving rise to the claim, or USD $25.

Some jurisdictions do not allow certain disclaimers or liability limitations, so some of the above may not apply to you.

16. Indemnity

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless FrogFen and its affiliates, contractors, service providers, and licensors from and against claims, liabilities, damages, losses, and expenses arising out of or related to your use or misuse of FrogFen, your violation of these Terms, your violation of law or the rights of another person or entity, or your interference with FrogFen, its infrastructure, or related services.

17. Termination

These Terms remain in effect while you use FrogFen.

You may stop using FrogFen at any time. FrogFen may terminate or suspend these Terms or your access to FrogFen at any time if you violate these Terms or if FrogFen decides to discontinue or restrict access to the app or its services.

Sections that by their nature should survive termination will survive, including ownership, feedback, disclaimers, limitations of liability, indemnity, governing law, and dispute provisions.

18. Governing Law And Venue

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules.

To the extent a dispute is not resolved informally, you agree that any claim arising out of or relating to FrogFen or these Terms will be brought exclusively in the state or federal courts located in Massachusetts, and you consent to the personal jurisdiction and venue of those courts.

19. Changes To These Terms

FrogFen may update these Terms from time to time. If we make material changes, we may provide notice by updating the date above, posting updated terms, or using other appropriate means. Your continued use of FrogFen after updated Terms take effect constitutes acceptance of the updated Terms.
